TERMS & CONDITIONS

The current season�s catalogue cancels all previous catalogues and additional price lists.

The sales office is open Monday to Friday, 8.00 am to 5.00 pm. Any other business will be conducted by pre-arranged appointment only.

Goddards (Nurseries) reserves the right to adjust prices without prior notice.

All catalogue prices quoted are price each and are subject to Value Added Tax at the statutory rate and exclude delivery charges.

ORDERS
The placing of an order implies acceptance of these terms and conditions.

All plants listed are offered subject to being unsold on receipt of order.

All goods are to be paid for at the time of order, unless a credit account has been opened. All first time purchases must be paid for at time of order.

All orders to be confirmed in writing with order numbers.

Acceptance of an order does not bind Goddards (Nurseries) to supply the exact items and/or the exact quoted price where events are beyond our control.

All plants are believed to be true to name but in the event of an error on our part Goddards (Nurseries) will not be liable to pay any compensation beyond the invoiced amount for any plant found to be incorrectly named.

Goddards (Nurseries) reserves the right to withhold deliveries or dispatch goods to customers that have exceeded their credit arrangements.

PAYMENT
Payment in full must be made for any stock reserved on the Nursery.

Whilst the responsibility for the welfare of the goods passes to the buyer upon delivery the goods remain the property of Goddards (Nurseries) until cash or funds have cleared to the full price of the goods.

At its discretion Goddards (Nurseries) will refuse or withdraw credit account facilities to the customer; credit account facilities will be withdrawn if the account is not used for a period of twelve calendar months.

Credit account invoices must be paid strictly within 30 days from date of invoice. Goddards (Nurseries) reserve the right to charge interest on all overdue accounts at the rate of 2% above the base rate.

Overdue accounts for credit account customers will be placed on �Stop� and no further transaction allowed until the outstanding funds are received.

Should a customer�s cheque be returned to Goddards (Nurseries) unpaid, the costs incurred by the inconvenience will be chargeable to the customer.

DELIVERIES
Delivery charges will apply on all order values below �150.00, net of VAT; these charges will be determined by the post code district of the delivery address.

All deliveries are to kerbside only. The customer or his representative is required to be on site to accept, check and sign for the delivered goods.

The customer where necessary will provide at his cost appropriate equipment and operators to unload in accordance with any legal requirements. Goddards (Nurseries) reserves the right to charge for time spent moving delivered goods beyond the kerbside or for any unnecessary waiting time at �30.00 per hour.

Any time or date quoted will be adhered to where possible but such times and dates are approximate and are not guaranteed. Goddards (Nurseries) will accept no liability for any delay in delivery due to any cause whatsoever or the consequences thereof. Any customer or his representative who instructs our driver to drive off the public highway does so entirely at his own risk and expense. The driver will do his utmost to position the vehicle to the desired location but will have the final say with regards to the safe operation of the vehicle at all times.

If goods are returned because we were unable to deliver a further delivery charge will become payable.

A restocking charge of 15% of the net invoice value will be levied for plant returns that are surplus to the buyer�s requirements.

Any complaints should be made in writing within seven days of collection or delivery. If by mutual agreement the plants are returned to Goddards (Nurseries) the customer will be deemed responsible for any damage to the goods, omissions or reduction in quality.

COLLECTIONS
Plants which are collected by the customer or his representative are collected as seen and at the buyer�s risk.

Plants must be covered where they are loaded onto an open back vehicle in order to prevent wind damage. Goddards (Nurseries) does not accepts responsibility whatsoever for damage caused in transit due to plants being loaded incorrectly and thereafter damaged in transit or transported in an uncovered vehicle.
